tenancy rights of a flat on pagri basis

The tenant of a flat has expired in 2016. Husband is now occupying the flat alone. All 3 daughters are married & settled abroad. Husband wants to surrender ownership rights to owner. Is NOC from all 3 daughters necessary ? The 3 daughters are abroad

dear client.if the husband of the tenant wishes to surrender the flat and ownership rights to the original owner then no need to take NOC from the daughter, but it will be advisable the terms and conditions between the owner and tenant shown to any advocate.

My advice shall be that it would be better if NOC is taken from them too, though legally I don't think there is any necessity. I feel one should always be on the safer side to avoid future litigation.
