Hello, my lawyer is suggesting to go for quashing in high court for an FIR filed under BNS85. how does quash proceed, do both sides lawyers are present in quashing and argue? how does the quashing process proceed?
You can reply with:
A quashing petition is filed before the High Court challenging the FIR on legal grounds. After filing, notice is usually issued to the State and the complainant. Both sides are generally represented by their advocates, and the Public Prosecutor appears for the State. The Court hears the parties, examines the FIR and relevant records, and decides whether the case deserves to be quashed. If the facts and law support your case, the High Court may quash the FIR or grant appropriate interim protection.
