Property dispute between sisters after death of grandmother

Hello i am student . i am writing on behalf of my mother .my mother's siter is causing trouble in sharing the property . after the death of my grand mother the property has to be shared equally . but my mother's sister want a bigger share of the property . she has the original land documents . we have only zerox still the property is not yet registered on my mother's name .we want to register as early as possible because there is wedding for our sister we want to register on my sister 's name . total property is 200 gajas . there are two houses on that property one house is big and other is small. bigger one is around 130 gajas and small one is 70 gajas . my mother's sister wants to give smaller share to my mother . if we try to question the reply was to complaing in court . we are no financially strong to meet the expences of court and fees of the lawyer . please give us advice how to perpare our selves and appear before court .

As per Hindu Succession Act, after the death of your grandmother, the legal heirs of of the predeceased legal heir, that is, your mother would get her share of property. So your mother's share would be divided amongst all the class 1 legal heirs of your mother. You should first of all apply for legal heir certificate from SDM office and succession certificate from court. After that if all the parties are not able to decide about the distribution of properties among themselves then a suit for partition may be filed by you.

It should be done on arbitrating both the parties and if not the other side party should get legal notices by the advocate to come forward and share equally initially there are no court fees to be bared it will be done by any advocate in your area go and consult a good Lawyer.
