Procedure to file for RCR in case wife not staying in matrimonial home

17-Nov-2023 (In Family Law)
I had first marriage, separated. Later I was married on may 7 2017 at my home town . I had my first night on 8th May 2017 and that day I just had partial sex. next day In an emergency I left to my office location leaving home town. We had a gap of 2 months. In July I asked her to relocate to present working location. we started living together. But fortunately, till now I didn't had complete sex with her because I thought first we should completely understand each other. Recently in the month of October she went to her home town. Their at her home she told her parents that till he didn't had sex and always use to scold. Listening to her words their parents called me and my parents and asked the reason behind this. we politely conveyed the reason that I was hurt by the ball and thats the reason behind not involvement in complete sex. But the actual reason is I thought first we completely understand each other. Now their parents named me impotent and not sending her to me but I love her

Hi,
The excuse you take not to have intercourse after marriage till you get to know each other well appear to be just an excuse. If that was the case you shouldn't have married without knowing her properly. Marriage is not an experiment. After marriage intimacy is the best way to get to together and bond which you have been avoiding it. Look at the course of events, after marriage non-consumption, there after you moved to another place and even after that she joined you no development and the worst of all is the excuse you gave that you have been hit by ball. Your behaviour lends credible amount of suspicion in this regard. So first I recommend you to get clarity for yourself by approaching a sexologist and then if all is well within you then go and disprove your wife and her family.

Sir, Do you obtained divorce of your 1st marriage.. If so, on what grounds... Coming to present marriage, Sir, Marriage confers certain obligations on both spouses. One of such obligation is to to have company or society .If any spouse withdraws from performing the marital obligations, without any reasonable execuse, the other spouse can serve a demand legal notice by an advocate ,asking to join the conjugal society. Later on, if the spouse doesnt join the conjugal society, then the aggrieved spouse can knock the doors of district court under Sec.9 of H M Act. If you need my professional consultation for serving a legal notice , etc, inbox me.
