Photo Upload On Social Media Without My Permission By My Wife.

I have registered a case of extortion against my wife in police station.But due to lockdown it is getting late to inquiry. But my wife is uploading photos of me and my family to harrassment purpose.Can I file FIR against her...or is there any legal process to stop her to do such type of activities.

You have not mentioned what kind of photos are being uploaded by your wife. I will assume that these photos are insulting to you and your family. You can file a defamation case under section 500 IPC against your wife if these photos are causing harm to the reputation of you and your family. If women of your family are in these picture then more section will be attracted in the case. As these photos deal with social media and internet section 66 of IT ACT or any other relevant section will also be attracted against your estranged wife.

You may file lawsuit for injunction thereby restraining her from doing such activities and to remove all such photographs. This can be filed immediately and Notice will be issued by the Hon'ble Court. Book Consultation for further help if you are interested.

Hi,

You have not given complete detail what are the photographs regarding , whether your wife is defaming you or what harm is being caused to you by uploading the photographs on the social media site.
Without the complete details it’s not possible to suggest a proper legal remedy.

But if you say that photographs are harming you or your family reputation or defaming you or your family member you can file the complaint.
