02-Jan-2023 (In Family Law)
I had a friendship with a person but we never married. Now the person has filed a petetion in Gwalior family court for RCR under sec 9. He is doing this just to take revenge. This has brought enough mental harassment to me and my family. Case is in court and its been a year and the case has not progressed enough. He has not produced any proof and he remains absent during most of the hearing and keep on getting the extension on the case.In nutshell, the institution of justice(court) has become an instrument for him to harass and take revenge. and after all this he is sending threatning messages to me i blocked him from my every social networking sites and I changed my contact number as well. He send email to me on the new year's eve. Is there any way I can get justice in a speedy manner?

If the case filed under Hindu law for restitutin of conjugal rights the person who is filing case has to furnish the marriage documents or other wise to prove that he was living with you for a period of more than 3 years in a locality and the locality people has to accept them as husband and wife then the bondage of marriage prevails if not it is not ,have got any proof like joint account /agreement of marriage or declared anywhere as husband and wife(including hotel room) it will be taken in to consideration by the court .let me know the clear facts of the case so that I can tell you correctly.

He has to prove marriage. Three only way you can do is to be present every healing and convince the court that he is doing this only as a means of harassment and you should oppose every time long date s are granted

Without proof he cannot prove you are his wife. Have filed an objections to the main petition? What are your contentions etc., If he is threatening file a police complain or submit before the court about his threat. You can also submit before the court proceed with the case day by day adjournments. If he is not attending the court submit the court dismiss the petition.
