My fiance is waiting for dissolving her first marriage

We are Muslims.Have any legal issue for marrying a girl who is trying to dissolve her first marriage by Qulah through court and it now in trial in court procedure.Also three months time was taken but the court procedures till continuing.if any problem in our marriage when the court procedures in trial.

Under Islamic law, a woman can remarry only after Iddah post-Qulah. Since her case is still in court, her first marriage isn't legally dissolved yet. Marrying now is invalid under both Shariah and Indian law. Wait for the court’s final decision, then observe Iddah before proceeding with Nikah to avoid legal issues.
