Mental Harrasment Section 498A

28-Mar-2023 (In Family Law)
I want to understand the law if a female who is going through a very tough time in her life and if she seems to be mentally harassed and can she seek for a divorce. I want to understand if she decides to raise her voice against what is happening to her what should be her first step, i.e. should she file in for a divorce first or lodge a complaint with the nearest police station - Will police officials entertain her/the complaint? Or they will just suggest sorting it out among the family? Can she also file a complaint with national commission for women? What if she is also forced to surrogate by donating her eggs ? Thank you for your help in advance.

Dear queriest, as per your query you have mentioned the what are the ways and also you yourself have mentioned those ways which are to be suggested, so therefore if you going through physical and mental harrassement and If you don't want to continue the marriage then you can take both steps that is make a police complaint and also file divorce under the grounds of cruelty and also under the provisions of Domestic violence. there are other ways to take legal steps, please feel free to call me for further information in detail.

approaching the police n women's commission first is a better idea. however they always try to shirk away from their responsibilities, so u have to be persistent. but as a lawyer my first advice to u will be to draft a complaint which cover your story and grief in complete detail and which make your case strong. rest is upto u. in case if u need any further advice u can call me anytime.
