Legal responsibilty of younger brother towards sister

What is the responsibility of a younger brother towards his elder sister who is going to get divorced and was mentally ill but now recovered? She creates lot of nuisance at home, abuses people all the time, humiliates family in front of everyone always. She writes all nonsense on Twitter and Facebook which ruins the reputation of my family. She has also called police and social worker home but no action was taken after listening to our story. My brother has gone into depression. My mom is dependent on him, father is no more. We need to know the legal steps in this case.

It will be first the duty of husband to maintain her as in the case of a married girl the husband is the Natural guardians as per Section 6 of THE HINDU MINORITY AND GUARDIANSHIP ACT, 1956. You can acquaint the husband of the same. Upon divorce she will get maintenance from her husband, Brother will come into picture if the husband or husband’s family is unable to maintain her.

If she has recovered and has no more mental disorder, then lodge an FIR against her in the nearest police station if she repeats such activities. Moreover, if she is going to have divorce, then she must apply for maintenance from her ex-husband under section 125 CrPC.
