Legal Remedy in case of Mental Harassment from Father

28-Oct-2023 (In Family Law)
I am 21 yrs old currently living seperately from my parents. My father had been verbally abusive and physically abusive (when in was 16). Since i started living on my own he has constantly harassed me and when i finally tried to cut off all ties with him he has threatened me to return my passport back to him otherwise he will create issues where i am currently living his saying is he paid for the document so i should return it i am ready to pay whatever amount he wants but he does not agree. I even have text messages from him. What can i do legally that he does not bother me?

You have not mentioned your gender. The remedy or the possibility of having a remedy will depend on your gender.

If you are a male then there is absolutely no remedy that is available to you. If you are a female then you can make a complaint under the domestic violence act 2005 against your father and seek various remedies which are provided in the Act.

The remedies that are provided r like monetary remedies, residential orders, protection orders, etc

I would suggest that you find out the reasons why there are misunderstandings between you and your father.
I would not advise you to have litigation against your own father. The best way is to avoid litigation and settle things amicably

As per your story, you r living separately from your father. Your father can't harrass you for any money claims. Still you have legal remedy to file civil case as well as lodge complaint with police authority. You can get interim injunction order from civil court for preventive order restraining your father from any kind of illegal action on his part. You can contact me for any further action.

You should file an application under domestic violence against your father to injunct him from entering your premises and harassing you. If you’re still a student and financially depended on him, you can also file an application for your maintenance and higher education.
