Leaving my house if I am an adult

09-Jul-2023 (In Family Law)
I am 21 year old graduate and I am addicted to smoking and alcohol due to which my parents scold me and threaten to beat me up with the help of my relatives. They also threaten to send me to a rehabilitation center. I want to leave their home and settle by my own but i fear they will use their money power and sources in government agencies to harass me to bring me back home. Can i leave my home as per the law without any harassment from any form of legal action?

Yes...since you are a major now you have got all rights to live according to your will and wish. If you wish to leave your home then you must first of all file an intimation letter to the police station according to your jurisdiction explaining to them all the facts of your case and in the end you must write that in future if any complaint filed by your parents should be treated as null and void. For more legal assistance I am just a call away.

Your parents can't pressurise you to remain in their house or to harass you in any way as you have attained majority. Going to the police station and giving them intimation letter is a BAD IDEA. Rather, we should send your parents a legal notice and let them be known that if they come anywhere near you to harass you, you will take restraining order from court. If you make a police complaint or intimate them about it, the police won't do anything, in fact your parents may tell the officials that you are an alcoholic and aggressive and a threat to society. For more assistance, you may call me.

Yes being an adult you can. you have all rights to take your decisions and no one including your parents can force you to return home. If they use force you can file FIR against them. But at the same time they can also exclude you from your share in father's property. If your parents are senior citizens they can also file a case against you and ask for monthly maintenance from you.

There can be a restraining act against the persons who harass you. yes as an adult you can leave your house and settle your own but as you mentioned that your parents can get you home with the help of their money power or sources in government agency, it is advisable that one should have a restraining order against them before moving out
