I am harassed by my wife. I want to separate from her. I have done a lot to her but troubling me. In judicial separtion, pls tell me what rights she can claim
Judicial separation is an intermediary state where the husband and the wife are ordered to live separately without dissolving their marriage with a view to reconciliation. If the situation worsens, either party may file for divorce later. At best, she claim child visitation rights, besides maintenance.
In case of judicial separation, the court can also deal with the questions of maintenance of wife, custody of children and property. In the case of Sohan Lal vs. Kamlesh it was held that in case of judicial separation, a wife is allowed to claim maintenance from husband in case she is not able to maintain herself
