Is NOC required for gift deed from brother if mother wants to gift

My Father-in-Law had died in 21/01/13 & he had not made any will and after 6 months the house they were staying went under redevelopment by a private builder and they got the possession in May 2015. now my Mother- In-law wants to make a gift deed of her part of share to my Wife ( Her Daughter) she has 1 elder son also do we need to take NOC from him to get this deed registered, but he won't give the NOC. Please advice.

Noted. Your mother- in -law has every right to transfer by means of gift deed, as her right title interest of the property. There is no any requirement of any no objection certificate from your wife's brother and any sibling ad per law.

No, for transfering her share she does not need NOC from anyone. She can transfer her share and the same can be registered without any hindrance. Make sure that her share is properly described in the deed.
