Is Legal Heir Certificate necessary for a jointly owned property?

Our apartment is jointly purchased and owned by my parents. The registration certificate has both their names as Husband and Wife. Now that my father has passed away, is a legal heir certificate required in case of any future sale of the apartment or reconstruction of the building.

After the death of your father, his undivided half a share devolves equally upon all the surviving Class-I legal heirs, including your mother. Therefore, a legal heirs certificate is absolutely necessary for any future transaction relating to the property.

Yes. For all means the legal heir certificate is required to be produced to show the surviving persons in the family. hence it is always better to get a legal heir certificate to avoid legal complications in future.
