It is imperative to know the allegations and charges levelled against you. If the charges levelled against you are of a serious nature then it would be advisable to seek Anticipatory Bail. Feel free to contact me for seeking any legal assistance as regards the same.

Although it is not necessary to get Anticipatory Bail from Sessions Court if 41 A notice has been served by police authorities, it is always advisable to get an Anticipatory Bail for your own safety and security from arrest.

No, it is not necessary to seek Anticipatory Bail from the Sessions Court after getting Sec 41A of CRPC, 1973 Notice from the concerned Police Station, considering, if the accused person can co operate in the Investigation considering, he is pretty sure, no evidences are against him, then for him, there is no need to take Bail.

It is not mandatory to seek anticipatory bail from the Sessions Court solely because you have received a notice under Section 41A of the Criminal Procedure Code (CrPC). A Section 41A notice is issued to call for cooperation in the investigation and does not necessarily imply imminent arrest. The purpose of this notice is to allow the accused to appear before the police and participate in the inquiry without being taken into custody. However, if there is a reasonable apprehension of arrest or if the nature of the allegations suggests a possibility of detention, you may consider applying for anticipatory bail as a precautionary measure. This will depend on the specific circumstances of the case, the gravity of the offense, and any indications that the police may move towards an arrest despite issuing the 41A notice. Consulting with a legal professional can help you assess the risk and decide if anticipatory bail would provide an additional layer of security in your situation.
