11-Oct-2023 (In Family Law)
I m a Hindu guy, who married with a Muslim girl in 2012 as per Hindu marriage act. She was following hes religion and I was mine. We both decided that we never interfere each other in their religious issue. Every thing was going fine. But when she come in touch of her parents she left me. Now we are parents of a 3 and half years old kid. Since Sep 2014 we are living separately but now we both want to live tougher. But now she want that I should convert myself from Hindu to Muslim otherwise she is blackmailing me for Divorce and forcing me to convert myself. I know she is in family pressure.I also wanted to live with her but without convert myself and her too. She is free to free to follow her religion, I only wanted to do that what, she is doing means force fully convert of any person is as per law or is it against the law? What action can I take and what will be the result. If I file a case against her and her parents and proved, what will be will be punishment according to law.

Firstly, the Hindu Marriage Act only governs Hindu’s. You should get married under the Special Marriage Act. Secondly its a fundamental right to be able to follow the religion of your choice. You can file a case for violation of fundamental right and also under any state law such as The Tamil Nadu Prohibition of Forcible Conversion of Religion Ordinance if you can establish that they are actually forcing you to convert.

Forceful conversation is not permitted under law, moreover it is offence under law. If u married the girl under Hindu Marriage Act, it deemed that girl accept the Hindu religion. If the girl or her family members persist u convert in Islam, then file a case against them.
