Conditions to File for a Mutual Divorce To file for mutual divorce in India, couples must satisfy the following conditions: Both spouses must agree to the divorce. The couple must have been married for at least six months and have lived separately for at least six months before filing for a Mutual Divorce. The couple must meet all financialobligations that they accrued during their marriage. The couple must live apart for at least six months after the Mutual Divorce is finalized to preserve any property or marital assets that may be divided between them. What Are the Different Religion Laws Regarding Divorce in India? There are a few religions in India that have different laws when it comes to divorce. The Hindu Marriage Act, of 1955 treats mutual divorce as a civil matter and allows for a person to get divorced without any legal proceedings. On the other hand, Islamic Personal Law treats divorce as an affair of the heart and requires two witnesses to attest to the fact that the couple has decided to get divorced. Some religious sects in India do not follow either of these laws and require a religious court to grant a divorce. The different laws that are followed by different religions when it comes to divorce can affect the financial aspects of the divorce and how equitable the divorce settlement is for both sides. If a couple agrees to get divorced under one of these religions, then each spouse will have to go through a religious proceeding. On the other hand, if you do not follow any religion, you can simply file a civil suit in court and get your divorce without ever having to go through any religious courts or proceedings.
