In-laws and family members are not allowing me to see my husband

27-Mar-2023 (In Family Law)
Ours was love marriage and parents accepted for name sake of our both side.since it has 4yrs we got married my in-laws are so abusive against me since from the beginning. They don't even talk to us. Three months back my husband had alcohol without knowing that there is a poison mixed in it. That alcohol bottle came through courier. After a police enquiry we came to know that one of my friend done this without my knowledge. And he has accepted that solely done by him because he wanted to marry me. He was once asked me divorce my husband and come with me but I completely rejected it. But now my husband has been hospitalised more than 3months. He has been discharged he had brain damage he couldn't recognise anyone an he is bedridden. My in-laws and his family members are not allowing me to see them. Am staying in my moms home now. They have taken my academic certificates and threatening me that they don't know anything about that if I ask. If I go to see my husband also they don't allowme

Madam, Your problem is a very serious problem. What happened to the Police enquiry? Did you inform the Police regarding the fact that your friend only gave the poisoned drink? Did the Police make any enquiry with your friend? Do your in-laws know about this problem? If they know about it, they will think that you were having an affair with your friend before your marriage. Did you go to see your husband? What happened at that time? Did you give a Police complaint stating that your in laws are not allowing you to see your husband? You have to 1st go to meet your husband. Next if they don't allow you, you must lodge a complaint with the Police. Next you can file a Writ Petition in the High Court under habeas corpus to produce your husband in Court. At that time the High Court will order your in laws to produce your husband in Court. Apart from this you may have to file other complaints against your in laws for Domestic Violence Act, cruelty etc. Kindly contact me to discuss your case in detail so that I will be in a position to give you clear and proper advice.

Hi,

File a DV petition before jurisdictional magistrate to get back your articles and testimonials. In parallel, file an harassment complaint with the local police against your in laws. They should oblige. Call me in case of doubt.
