In 354 IPC can the accused ask the court or give an application

17-Oct-2023 (In Family Law)
In 354 IPC can the accused ask the court or give an application for the woman's polygraphy test? The woman is lying only to extort money and harass the in laws. The query is in subject to my father on whom my wife has put up such false allegation. Is there any provision for this? Does it help? What else can be done in such a false allegation?

If your wife had put wrong allegations on your father and the FIR has been registered then first of all you should apply for anticipatory bail and then you can always file section 9 if you wish to continue the matrimonial life with her or else just file a petition for divorce under cruelty grounds. I would suggest a mutual divorce will be better.

No court doesn’t give such orders in such cases. It’s the matter of trail. Kindly hire an expert advocate to use expertise. You need to provide all facts to your advocate subsequently he will use his legal mind to bring them at appropriate time. Plz b in touch

Sir, the court can't compel a party to give a polygraph test against his/ her will. Though, if the party himself/ herself wishes to go for it then the court may allow it. You have to appreciate the fact that even if she doesn't come clean in that test, the court can't pass order(s) against her for lying on polygraph. If you need assistance you may consult me
