If I move out of my own house with Kid how to claim my property back

20-Jan-2025 (In Family Law)
I have Divorce case, 498A & G&WC cases going on & wife is staying together, due to her cruelties in G &WC I am planning to ask Court to grant me permission to move out of the house to prevent further exploitation of our kid.House is jointly owned by my father and myself. If I move out is it like giving permanent possession of property to the wife and I wont be able to claim it back or atleast half share?I am ready to pay maintenance to her as my primary objective is welfare of our son.I am Hindu.

Dear Sir, Never do the mistake of leaving the house to the exclusion possession of your wife. You may not get it back. Better shift her to any other rented house or leased house. Second option is get your house leased out and give possession of the same to the third parties. It is matrimonial house of your wife and she may stay permanently in the said house.
