I am hindu. I am only child legal heir my mother died she made me nominee as my minor brother died now society does nt want to transfer flat in my name and also I can't afford high maintenance so 21% interest in charged on me

As the sole surviving legal heir under Hindu law, you may be entitled to have the flat transferred in your name, subject to submitting the required legal documents. If the society is refusing the transfer or charging excessive interest, I can help you take the appropriate legal action.

Nomination ≠ ownership. Get Legal Heir/Succession Certificate as sole Class-I heir (Hindu Succession Act). Submit to society for transfer. If refused, file dispute with Deputy Registrar, Cooperative Societies. Request interest waiver citing transfer delay.

the mother died without leaving a Will, and you are the only surviving Class I legal heir under the Hindu Succession Act, you are entitled to inherit the flat. A nominee is only a trustee who holds the property for the legal heirs and does not become the absolute owner merely by nomination.
