Husbands abusive behaviour problem newly married

Marriage 1 month old husband abuse , verbal fights increased ..hindu marriage what course of action advised ..initial family meetings with elders happened to discuss behaviour ..pls advise,also interference of sis in law and other family members

It is advisable to first attempt a mutual settlement, especially considering the marriage is only a month old. If that is not feasible, a mutual divorce may be considered, though it would require demonstrating to the court that the marriage has broken down irretrievably. Alternatively, if there has been consistent emotional, verbal, or physical abuse, legal recourse may be sought by filing a case for cruelty and/or under the Domestic Violence Act. Hello. There are various remedies available to you depending on the main issues, when we say abuse, is it language, is it violence and what is the behaviour of the family members overall. Basis that we would be able to suggest the exact recourse we should take. The best way is obviously counselling and mediation to solve the situation, but if they are not willing to improve the entire situation for you, then we will need reliefs through Court only. If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.

As an advocate I will suggest you to file a case with cwc first and then let the other party respond to it. You will need the support of your own family members to sort out the issue. in case you are looking for a judicial separation then also it is possible in this kind of case
