Husband not willing to leave mother and stay with wife, what to do

01-Dec-2023 (In Family Law)
My sister is married for 2.5 years and they have a 1 year old child. Her mother in law always had issues with her being close to her husband and because of that there were severe problems which we gave our best try. But as of now she's not ready to stay with her in laws but with her husband in a different house. He barely visits them even if she stays there. She doesn't want a divorce . Her husband is not ready to move out with her. What's the solution for this situation. ?Please help

See your sister's husband cannot be compelled to leave his mother and stay with you regarding sister. However, she can file a complaint against her mother-in-law under Domestic Violence Act which would make her mend her ways and smooth things up.
Apart from that she can also file a complaint of breach of trust stating that the mother in law is poisoning the mind of the husband.

The facts posted suggests no legal elements or issues therefrom. It is better that you and your family leaves your married sister to take decision in her married life.....

Hai.
since she is not ready for divorce an application for restitution is not recommended by me. Because the query clearly states tat the bond is in a little bit fragile stage any allegation with a slight boost from mother may make things worse. Do a thing consult a civil lawyer n lodge a mild PLP or maintainance case with petty allegations. Do ensure tat the allegations raised will be mild n wont make hard effects. Keep contacting with ur husband dont make the bond go any longer. Consult a lawyer
hope am upto ur query
