28-Oct-2024 (In Family Law)
Hi My husband hit me really bad and left home, now he is trying to connect my Son to get back again, I am in a dilemma, I have kids but getting back together is giving me shivers what if he repeats this behaviour and hit me again, I have small kids to take care of. I also not sure if I want divorce, what are my options, kindly guide
Take an appointment and consult an Advocate for your serious marital discord issue. You should act as per the advise of your lawyer only. Do brief him and explore Legal remedies apart from Divorce. Do file an intallah peshbandi through an Advocate. You can file a complaint under the Domestic Violence Act also
If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself as well as for your minor child. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
