Husband denying to pay maintainance

My husband 48yrs and me 45yrs married in 2011 having 11yr old daughter ,my husband has borrowed 7.20lacs by blackmailing me emotionally now not ready to repay the amt, he is trading addict,alcohol addict abusive and violent ,after staying for 13yrs with him now I have decided to take Judicial Separation frm him ,I've filed DV case ,he has stopped paying HL EMI,paying daughters fees &household expenses last 4-5months he isn't ready to pay us anything+he has made me spent 10L in home interior.
If you haven't filed any application for maintenance then you should file one. Further, you press the said application before the Court for non-payment of maintenance amount. If he defaults in payment then probably a distress warrant against him may help. Feel free to contact me for seeking any legal advice as regards the same.

Claim interim maintenance from your husband for yourself and your child in your DV matter. If he refuses to pay, take out distress warrant against him for the execution of maintenance order against him.

Well, if you want to recover Maintenance from your Husband, you can file a Maintenance Petition under the concerned provisions of the Bhartiya Nyaya Sanhita, 2023. Maximum, you can seek 25 % of the Maintenance from the profits which Husband makes from his job or business.
