Husband and inlaws are torchering mentaly how to get divorce and child

My sister is married for 5 years and blessed with 3 yrs old girl. From last 5 years, husband and his family used to create tension in house for money matters and other things too. She has to share almost 80% of her salary for house hold expenses to avoid chaos in the house. This is not only limited to this. No one talks to her in the house for months even after doing all work. Husband talks with slang and abusive language and his parents don't stop him. They are influencing kids mind also. Sometimes, even kid is also not coming to her. No one will support her for any argument, instead they will scold her. She is depressed of her life. She is just like a money making machine with No life. Hindu . Can I get divorced with child possession?

Yes! Ur sister can get divorce and a custody of child. You have to approach the family for separation or divorce and application for custody of chikd, samutaneously u can file section 12 Dv act against husban

Hello, For the query you posted, I would suggest the following: In the scenario you had potrayed, I find that you sister can get a divorce along with filing the said petition you can as well claim the custody of the girl child. Yes, your sister may seek divorce alongwith the custody of the child. Your sister may also seek maintenance from the husband for herself as well as the child if the situation is favorable until the divorce is settled. You may also file a complaint under the Domestic Violence Act too. Contact for proper action.
