If you're regularly paying court-ordered maintenance and your wife has still filed a petition for salary attachment, you can contest it by providing proof of regular payments. Here’s how you can rectify this: Steps to Take: File an Objection or Counter Affidavit: Immediately file a written objection in the same court where she filed for salary attachment. Mention that you are a regular payee and attach proof (bank receipts, transaction slips, court challans, or any official receipts). Collect Proof of Payment: Gather bank statements, payment receipts, or any acknowledgment that you’ve been making timely maintenance payments. If you’ve paid through court deposit or money order, attach those records. Attend the Court Hearing: Be present on the next hearing date and present your objection through your lawyer or in person. Politely explain that salary attachment is not necessary as you’re already complying with the court’s maintenance order. Request Rejection of Her Petition: Pray before the court to dismiss her petition for salary attachment since there is no default on your part. Optional – Seek Costs or Warning: If her application is found false or unnecessary, you may also request the court to warn or impose costs on her for misusing court process. Legal Support: It’s strongly recommended to consult a family law advocate who can represent you effectively and help prepare your written objection. Let me know if you'd like help drafting the objection petition.
