18-Mar-2023 (In Family Law)
I got married (Hindu) in july 2017 due to a case file against me for rape. That case is still under litigation in court. Now my wife is threatening us to file a false case against me & my family for dowry and domestic violence. Me & wife wife is not living with my family. She is trying to extort money from me & my family. She threaten me by saying that she will target my family now for money because i have nothing much to give her. She is abusing me on daily basis and texting me very vulger and abusive messages. She is having physical relation with some other rich person and fulfilling her financial desires. I & my family is facing a mental trauma due to this threat. What i can do to safeguard me & my family not to suffer any further case on us? We already having a big case against us for which litigation have not started yet. Please advice whether i can go to police station or what. I don,t want to take any action at this point of time as we need her in court for her statement.

You can go to a police station but it will not be of great help as you are not having any evidence. Firstly you should try to collect evidence and then you should approach police or court. In such cases the law always favours females.

Cruelty is the main ground to seek divorce as defined under ‘Sec 13(1) (i-a)’ of ‘The Hindu Marriage Act, 1955’ and party who is filing a case must prove that living between husband and wife became impossible.
Misuse of Laws by the wife against husband in society is growing day by day and most apparently some Indian Urban educated women have turned the tables and are using these laws as weapon to unleash personal vendetta on their husbands and innocent relatives.

Better elucidation of facts may help us to guide you further. Meanwhile, you may start collecting evidences/proof of the ordeal being faced by you and your family, which could be helpful in case you take any lawful action .
You may reach out to me at my phone or in person, if required.
