How to make make legal paper of the property

I am living on my granddfathers land .which have 5 legal heirs including my father . On half of the land there is a collaborative construction between us and one of my uncle or chacha . My mother and my 3 brothers don't want to make legal papers of that collaboration . So how can I and my chacha individually make my our paper of ownership .

Since the land is ancestral and there are 5 legal heirs, no individual can claim exclusive ownership without a proper partition. You and your chacha can file a partition suit or execute a family settlement deed with consent from other legal heirs. If others refuse to cooperate, approaching the civil court for partition and separate possession is the only legal remedy. Only after lawful partition can any construction or ownership papers be registered individually.

As per Indian law, if your grandfather’s land has not been legally partitioned among the legal heirs, no individual can unilaterally claim ownership or prepare ownership papers for any specific portion. You and your chacha can only execute ownership documents if there is a registered partition or family settlement signed by all legal heirs. Without this, any collaboration or construction remains informal and does not grant exclusive ownership rights. It is advisable to first initiate a legal partition process through mutual agreement or by approaching the court if consensus is not possible.
