How to file case for divorce and maintenance against my husband

Hii meri sister apne husband k sath rhna nhi chahti uski sadi 2001 main hindu dharm se hui usk teen bache hai .usk husband usk aur usk bache k sath bhut cruel behave krta tha isliye o 2014 aug main ghar chor mayke chli aayi bacho k sath.she think usk husband ko galti relise hogi o sudhar jayega bt avi v o mayke aakr ldai krk jata hai .so finaly o legal step lena chahti hai .use kya case file krna chahiye divorce yah maintenance .usk husband BCCL employ hai dhanbad main. what can be done?

Hello sir as per ur case urs sister has.option to file divorce and maintainance case against his husband.As law permit such while case relating to his cruelty criminal case can be loged against him .Chance of divorce is greater.

you need to file three petition altogether,divorce petition under section 13 of hindu marriage act,maintenance petition under section 125 Crpc and interim maintenance under section 24 of hindu marriage act. however obtaining decree of divorce may take some time but for maintenance case will not take more then three date. DEAR MAM FIRST YOUR SISTER AND ON BEHALF OF CHILDREN'S REQUIRED TO FILE MAINTAINANCE APPLICATION UNDER SECTION 125 OF CRPC BEFORE THE FAMILY COURT WHERE YOUR SISTER RESIDES. SECOND YOU SISTER IS REQUIRED TO FILE DIVORCE APPLICATION UNDER SECTION. 13 OF HINDU MARRIAGE ACT TAKING PLEA OF CRUELTY. FURTHER IF REQUIRED ACCORDING TO SITUATION YOUR SISTER MAY FILE A CRIMINAL CASE AGAINST THE HUSBAND TAKING PLEA OF CRUELTY AND MISBEHAVE.
