How to deal with case under 498 IPC

Sir meri sadi 25 feb 2016 me hui thi.sadi ke kuch din bad hi meri wife meri family ko pareshan karne lagi aur mere se khne lagi me tunhare sath job par hi rahugi uske kehne par me use apne sath job par le gaya waha par wo mere ko khana bhi nhi deti aur kehti me tujhe mar dugi aur tujhe juthe case me phafa dugi.wo mere sath mar pit karti .ab usne mere aur mere family par 498a ka case laga diya.is sabhi ki application mere pehle hi de rakhi h.ab me kya karu sir
High court mein ap apne upar ki gayi FIR ko quash karwane ki darkhwas daliye. Is yachika mein interim relief mein arrest pe stay le lijiye. This is the only remedy for you. Once the chargesheet is filed, file a petition in the high court under section 482.

If the FIR has been lodged then you have to take bail from the court, else you have an option to go to mediation centre. Police will send the case first to mediation centre and you can resolve your issue there.

Approach the magistrate concerned through lawyer by way of an application stating all these. Keep all the evidence material ready. In case of any difficulty you can approach the High Court if you are native of Uttar Pradesh as there is no provision of anticipatory bail in Uttar Pradesh. If you belong to some other State where provision exist for anticipatory bail you can seek anticipatory bail from Sessions Court and if not granted then you can approach the High Court for the same.
