How can I claim maintenance for me and my child from my husband?

i have been married since 2013 i m lodhi rajput , it was an arranged marriage , during time of fixing marriage they have not demanded anything clearly. after marriage my husband start taunting and misbehaving with me. he never provided me money asked me to earn and fulfill ur expenses. my mother always used to threat me for re marrying his son if i fail to conceive baby . i was in trauma at last i given birth to baby boy on 2nd Aug 2016. but on 1st nov 2016 my father in law misbehaved again and all of them physically and verbally abused me and my father in law brought me in general compartment with new born .i along with baby suffered a lot. my FIL abused my parents and said never sent your daughter again. from that day my husband didnt called me not even sending money for baby and me. my father is paralyzed patient and get retired in june . kindly help me by your fruitful advice.

As your marital status is not disputed and you have a just 5 month old new born baby with you you have full right to claim maintenance from your husband.
1. You can file an application under section 125 of Criminal procedure code for demanding monthly maintainance on the ground of desertion from your husband for yourself and your baby.( before concerning family court)
2. You may also file an application under protection of women from Domestic violence Act ( before JMFC Court ) for various reliefs including monthly expenses, medical expenses, apartment rent etc .

My advice to you file 125 crpc aplications against your hasband for maintenance you have right to take mentanenc you and your baby in family court if you leave in city otherwise file any first class magistrate's

There is available legal remedies for your case under Cr. PC. You need to provide the details of your city where you are reciding. You certainly can get maintenance for you and your child as per the status of your husband
