28-Nov-2023 (In Family Law)
I 30 year old & belongs to Hindu religion and my spouse belongs to Muslim community. What is the procedure for marriage registration. We got married in 2016. We just came no know that inter religious marriage has to registered under special marriage act (which is only applicable when both parties are unmarried & not living together) Is it true ? Also we are not ready to convert and our name cannot be changed for the purpose of marriage. Please guide us properly

You can get your marriage registered under the Special Marriage Act after the marriage and also before the marriage showing your intention to marry.
First of all you need to fill the application for registration of marriage and submit it in the SDM office of your area along with attested copies of documents which show your identity and other details.
After that the SDM waits for 30 days for any objection to the marriage on any ground from any third party and if the SDM finds it genuine he strikes off the registration. In that case you can make an appeal in the district court. But practically, such a thing rarely happens.
Further there is no requirement of changing the name or religion for the parties under the Special Marriage Act. Also as one party is Hindu and another Muslim, you must get the marriage registered under the Special Marriage Act otherwise your marriage will be invalid.
