Hiding Details In Income Affidavit

26-Oct-2024 (In Family Law)
My wife has not given a detail of single bank account but I have proof that she has a account in which I am regularly sending some money. Second to enhance her maintenance she has shown her parents as dependendent on her as she is single child and have not given a single detail of their business bank account ITR and three properties they have along with rental income. My question is how to proceed further in court in order to attract section 340 crpc ?

Sir You have to move an application under section 340 Cr.P.C. But, generally, it is decided at the end of the trial. But, I have procured some judgements based upon which it can be heard initially. You may consult me in that regard.

Do seek a detailed legal Consultation from a lawyer having expertise in matrimonial laws. If you have the details an application can be moved to serve interrogatories to produce the matrial on record as per the latest Supreme Court Judgment. We had recently done this in one of Our matter

if the case of maintenance is filed and has been argued then it is advised that you should present the evidence of presenting the account statement on which money has been sent by you. Also mention the name of the bank and the person in whose name the account is established. it is advised again that the details which you are aware of should be put in the court in terms of affidavit
