Formalities of marriage under Hindu marriage act be done outside India
15-Jan-2023 (In Family Law)
I want to check the formalities for marriage outside India through Indian Embassy. Bride and Groom both are in same country. Intend to go for Court Marriage. Is it advisable outside India or better to visit India to complete the formalities. Kindly advise the procedure in both the cases.
Hello,
Sorry for the delayed response. Foreign marriage of Indian Nationals ( or between any two people out of which at least one of them is an Indian citizen) is governed by the provisions of Foreign Marriage Act 1969. In your case both the parties (assuming they both are Indian citizens) can solemnize their marriage in any foreign country before the " Marriage Officer" , who can either be a diplomatic officer or a consular officer. Diplomatic officers can be anybody from ambassadors , envoy, minister to high commissioners. The parties can also solemnize their marriage on their own as per their customary norms however it should not be against the local laws of the country and after which on the desire of the parties the marriage officer may also register the marriage. Once registered , the marriage shall be deemed to have solemnized under the Act. This shall ensure that all the formalities are met with and the marriage shall have legal sanctity in the country where it has been solemnized as well as even before the Indian Courts. So the parties need not compulsorily come down to India to get married.
Hope this resolves your query. For any further details feel free to contact me.
