Forgery/signature potentially related to personal property

20-Jun-2025 (In Family Law)
An NRI has close relative in Delhi. This person might be nervous that he may be shortly be accused of holding on to the NRIs personal property without their knowledge. This vindictive person may forge the NRI’s signature on a newly-created document and claim that the NRI gave him possession while on trip to India. He will then go to police/court proactively. Question is – are forgery cases easy to prove in India? The NRI is too outdated on the Indian scene at this point.

since the question pertains to an imaginable situation it has to be answered that way itself. If the forgery is done by any person then the aspect of forgery is to be treated with the documents which are forged. Since forgery is a criminal case in India so the person who has been forged requires to file an FIR and then await for the evidence to be produced. so it is a hypothetical question what forgery are we talking about and what is required to be proved

Proving forgery isn't easy, but it's provable in India under IPC Sections 463-471, requiring strong evidence like expert handwriting analysis, the original document, and circumstantial proof (e.g., NRI's absence). NRI's Actions: File an FIR, issue public notice, and initiate civil suits for declaration/injunction. Secure original property documents. The NRI's absence can be key evidence. Act swiftly with legal counsel.
