Foreign tour when booked under Section 498(a)

28-Jul-2023 (In Family Law)
Hi , My sister in law filed 498 a case on my parents and me in the year 2016 in Mumbai. However we all got anticipatory bail 6 months back. Me & my husband are planning to travel Indonesia on short trip. But the bail states that We need to take approval from court to travel any foreign country . I just need information how long the whole process will take and Do we need to submit any amount in court? And Are there any chances that court doesnt give us permission?

In the present scenario, the Supreme Court has laid down some guidelines for the investigation of offence under section 498A. Even the Courts have considered that the shield given to women is used as a sword. You can apply to court in the form of application and you will definitely get allowed to travel abroad. No need to deposit any money in Courts, however, procedure may change in Mumbai.

sir,
in this case you have to file appropriate application to the concerned metropolitan magistrate with a specific and appropriate reason that why you want to go abroad. You have to apply for non objection certificate from the court.
