Filed a divorce case against wife wants to appeal ex parte

I have filed divorce case against my wife in civil court 08 months ago she is not attend any hearing in court I want to appeal Ex Parte. My lawyer is every give me same reply case is one sided. what is the procedure of Ex Parte appeal in court this ex parte appeal is my lawyer in court or judge is issue ex parte. My wife is case on me 3 & 1/2 years ago domestic violence and maintenance that case also pending.

Exparte is not appeal ...its a stage in running matter. Exparte means to proceed with the matter without other side. When court pass expatre order thereafter you have to give your evidence after that submission of documents if any file and then lastly argument of your lawyer....then judgement. That's it.

dear client, your wife already filed a case against you 3 years ago hense if the judgement of that case is still yet pending, hense as per my opinion, it is very difficult to get your decision ex-party. but as both are living separately more than 3 years is an also a ground for quick judment.if possible contact me by phone so that I can understand the case in detail which can helpful for you for a proper decision.

We can appear for both cases whatever the case may be and we can file exparte matter whatever it may be and accordingly we can proceed with the law and the guidelines of the law in both the matter as mentioned by you
