That is really bad but unfortunately you have no right over the property of your father. Whosoever had contributed to him that cannot be considered as claim on such property. On legal term everything can be accepted only written, if your mother name not on that property, you should talk with your father regarding ur rights, if he agreed. On the other way if your father torturing your mother in that case u can file the lodge against your father for torturing her on domestic violence Act 2005.

Hi, Your father deserted your mother long back but there is no formal divorce of her from him botany petition is pending under any act for the domestic violence and cruelty to your mother. As he purchased the property occupied by the family he may force to live in. Your mother may file a divorce petition in case she don't want to live with him in the same house. Above all you all need to sit together and discuss the amicable solution to reunite the family as this is not evident in your query that he had any other wife or family. Since the property is in his name and if you all are adult he may get the you evicted except your mother.
