Family Property Issue, however the property owner is my mother

16-Nov-2023 (In Family Law)
We have a residential property in the name of my mother. My father and grand father has passed away. Post that my mother bought the existing property in her name. Now, we are two sons only. My question is if my mother wants to sell the property and is ready to give equal amount to both of her sons. But can my brother pursue a legal case if he doesn't agree with the selling amount or because of any other issue. Can he stop my mother to sell the property?

Hello, Your mother is the rightful owner of the property and no one can stop her from selling it even at a zero amount. You just need to see if it’s self bought property or inherited one. Regards Adv Sakshi Garg Delhi High Court

Where did your mother get the funds to purchase the property? That is also the question ! If your mother wants to sell the property she can sell the same is she is the sole owner of the property! Your brother cannot dispute over the selling price Thanks
