First of all no one has got the right to claim the pension from the spouse of the deceased person. And also as the mother is 75 years of age she wants more care and attention and also is in dire need of that pension. If the mother is getting disturbed then she can also file a complaint under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. For more legal assistance I am just a call away.
