26-Jan-2023 (In Family Law)
I’m pursuing a very long relationship with someone and now we want to settle down he wants to buy his own flat as his mother is not supporting me neither she is welcoming our union. The guy previously bring me in his home and I stayed with him and his family for 3 months during the time when his father was hospitalised and after that died. We thought we will do registry and maki it legal but his mother and married daughter created a lot troubles for which I need to leave his house and from then we are living separately. During this he has given me A sum of 5 lac rupees. Now it’s been one more year we are still struggling my father passed away and he stood by me always when no one is there. Now he wants to buy a flat for us living together away from his family. For that he wanted me to give him back 5 lac rupees which he gave. I told him I will give you but first you do the marriage registry but he told me we will do it after purchase and will make it legal. What shall I do now?

kindly do not take me as being judgmental but from the benefit of the experience that I've gathered over a period of time both by virtue of my life and more importantly from my professional experiences I can sense an inclination of illmotive behind the suggestion extended to you by your boyfriend. and you have stood your ground very correctly. I think that's a very reasonable suggestion of yours and you should stick on to it. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.

Hello Miss, I really appreciate that you have asked your spouse to first do a court marriage and then you will give him the 5 lacs that he has asked for . I would like to tell you that court marriage is no rocket science that needs to be delayed for buying the flat so that you can live separately from your parents. Court marriage is also not a costly affair that needs to be delayed for purchasing the flat. There is a possibility that your spouse may not marry you after you pay him back the money as he is already being pressured from his family to not marry you. So I would suggest that you stick to your stance of first getting the court marriage done and later on you would pay him the 5lacs. Regards Niladri Shekhar Pal
