21-Nov-2023 (In Family Law)
My father got the property from grandfather being coowners after death. I am unmarried daughter aged 41 and he wants to sell the house divide the money equally between my sisters and me and brother. I dont want money but i want to stay here only. I am financially dependent. Can he sell the property or evict me by giving 1/5th of monetary value. If yes, how long can I drag this in court so that i cant stay here meanwhile.

get a residence order under the PWDV act and while you can't stop your father from selling you can certainly prolong the litigation by preventing the new owner from evicting you from the house with the residence order. this will be applicable only if you unmarried and financially dependent on your father. (I.e to say unemployed) thanks & regards, Tanmoy Chattopadhyay, M.Sc (Net Qualified), LL.B (University of Delhi), Advocate, Hon'ble High Court at Calcutta.
