Does apology letter from accused is helpful in domestic violence case

06-Jan-2023 (In Family Law)
Hello, I'm Ranjitha, I'm a victim of domestic violence after continuously suffering for more than two years of my husband and his father's torture(they tortured me even during my maternity period) I filled case against them and FIR is filed(IPC 1860(498a,323,504,34), dowry prohibition act, u/s 3,4) . Now I have 10 months baby. My husband is now asking for negotiation and he's promising that the past will not be repeated and for baby's sake I'm also thinking to agree to him. He's ready to give apology letter. Now my question is how the negotiation process should be and is getting apology letter helpful for me, if he repeats his old behavior??? Please guide me on this regard

Hi.. you can use the apology letter as evidence in your case. if you want to settle the case you both have to report the same thing before the court and after taking permission from the court you can settle the case and if he repeat the same act you have to give complaint once again.
Thank you

Hi Ranjitha. Sorry to know the state of affairs.

As you have already filed an FIR & the case is prosecuted, hence the apology from your husband will have to be tendered in the court to the Judge for which you will have to raise no objections if in case you wish to withdraw the charges levied on your husband and his family on the basis of an unconditional apology and assurance that such issues will not be repeated. The court will take cognizance of this matter and issue proper directions to dispose off the case.

Dear Madam,
If you believe your husband’s wordings then get him enter into a compromise privately and get some amount deposited in your name and say that if he continues same behavior then you are entitled to enjoy that amount. Such private agreement may be filed before the Court and withdraw the case. You can lodge complaint at any time in future in respective of your earlier compromise.
