Dear Sir/Madam, I would like to ask for legal advice regarding my marital rights. I want to know whether I can live separately with my husband without my mother-in-law’s involvement in our marriage. Is there any legal provision or law in India that allows me to claim this right to live separately from in-laws? Also, can I ask my husband to arrange separate accommodation for us? Please guide me on what legal steps I can take. Thank you.

If you have strong reasons for you and your husband's judicial separation due to serious marital discord or cruelty, you can file for judicial separation under section 10 of the Hindu Marriage Act. This is a legal process made by the Court that may allow the spouse to live apart without dissolving the marriage. You may request the court to provide accommodation and maintenance. You can file a petition for judicial separation, and can claim maintenance and separate residence under the relevant provisions. Immediately consult a lawyer for relief including separate accommodation and maintenance.
