01-Sep-2023 (In Family Law)
My sister has been murdered by her husband and her in laws due to dowry. Dowry case is going on in session court. My sister left her 9 month son who is with me since the night she was murdered. None from her in laws took 9 months baby responsibility. Now I do not want those murderer to snatch this baby from me. What are my chances to save my sister's son from her criminal husband and family if he comes out of jail on bail. They can go by any means to finish this baby.

Dear ma'am. You have pretty good grounds for claiming guardianship of the baby. I would suggest you to get a petition filed for the guardianship before he comes out of jail. For assistance you may consult me.

The primary factor in deciding the custody of a child is the child's welfare. If the father of a child is a murder accused of the child's mother and if it can be shown to the court that it would be detrimental to the welfare of the child if his/ her custody is given to such a father, the court may decide the matter as to who would be in custody of the child in that case.
