Complaint against Neighbor creating nuisance by keeping dog.

File a petition under Section 133 of Cr.P.C in the jurisdictional magistrate court praying for removal of the dog nuisance in your neighborhood. The court will pass a conditional order for removal of nuisance. For better understanding of the section, I would suggest you to read the content in the Section 133 1(f) of Cr.P.C. Coming to filing suit for claiming damages from your neighbor due his dog's activities, you can file the suit in the jurisdictional civil court after paying requisite court fees in the court for the amount you are claiming as damages.

Is it a public place where the dogs are kept in the night . Try to close the issue by talking with your neighbor . Burden will be more on you legally to prove that you are effected . In this case your allegation has to be proved that for discomfort and it is effected to other neighbours as well and general public in the vicinity if so then you can file a petition as per Legal provisions regarding Removal of Public Nuisances under section 133 of the Code of Criminal Procedure, 1973.

what in case lawyer themselves are creating dogs nuisance in a colony then how to handle it ? Pls suggest.

If any person, lawyer or not, is causing a nuisance through their dogs, you can inform the police or file a complaint with the District Magistrate or Executive Magistrate under Section 133 CrPC. The Magistrate may then issue a conditional order requiring the person to destroy, confine or dispose of a dangerous dog in the manner provided in the said order, appropriate action to prevent the nuisance or face legal consequences.
