Compassionate appointment & death claim benefit after father's death

Sir my father was in semi govt. Service in lic of india. He has six children from two wife. After first wife passed away he marriage second. Second wife yet alive.From first wife he have 3 chlid one daughter married and two unmarried son. From second wife he have three uunmarried daughters.first wife's children are elder then second.in his service book nominee was second wife. First wife's childs education qualification are under 12th. Second wife's daughters are graduate. Sir my question is- 1. who is legal heirs for compassionate appointment if both sides are apply for?2.who is legal heirs for all death claim benefit? Thanks

Dear Client, your 1 Question answer is you have legal heirs of your father and you have any one side of claim of benefit and compassionate you have no right for both side to legal compassionate and claim, so you have any one right of the legal heirs.

Nominee stands the first chance legally. In law nominee has a special place. Nominee becomes the legal heir and it is immaterial whether he or she is born of first or second marriage. So g shad and let the nominee enjoy his right.

Dear Both child is entitle to get the compassionate appointment as all the six children are legal and legitimate so the all is having equal chance to obtain compassionate appointment. Being a second question all are legal heirs so all are apply and get benefit.
