Elder brother can transfer the property in the manner he or she wishes to as it is his self acquired property. Hence, it is his wish and desire whether he wishes to transfer the property in your kids' name or in the name of whoever he wishes to.

Dear user,

If adoption took place by way of adoption way it is valid in the eye of law the entire share of brother will go to is adopted son ,if adoption is not took place as per norms then you may get your share.
