Can parents sue children for not taking care of them

31-Aug-2023 (In Family Law)
As all children have equal responsibility to take care of parents financially, physically and emotionally, is it possible to have a legal agreement regarding the same. If any of the child does not look after parents physicallt, is it possible to sue the child who has not taken care and get compensation

Yes, where there are siblings there could be an arrangement of sorts between them and their parents to shoulder the financial and other responsibilities of the parents. The law has also provided for right of parents to be maintained by their sons under section 125 of the CrPC.

As per Maintenance and Welfare of Parents and Senior Citizens Act, 2007, it is a legal obligation for children and heirs to provide maintenance to senior citizens and parents, by monthly allowance. (Rs.10,000/- is max per current limit, though 15% of earnings after tax or 10k which ever is more would be a more meaningful number)
Children- Include son, daughter, grandson, grand daughter but does not include a minor.
Even though the application can be filed against any of children/ relative as the case may be, such respondent-children/ relative can implead other person who are liable to pay maintenance.

Yes the childrens are bound to look after the their children. If they are not taking care of the parents, the parents have right to get compensation under the provisions on criminal law. You can approach to the hon'ble court for the relief maintenance. Kindly contact further details.
